Erick Erickson, a Christian broadcaster and host of the Erick Erickson Show, said that Florida’s recent tort reforms are reducing insurance costs and present a model other states could follow.
“Governor Ron DeSantis has gotten meaningful tort reform passed in Florida that is already bringing down costs,” said Erickson.
Florida’s 2023 civil justice overhaul, known as HB 837, has reshaped the state’s litigation landscape by tightening rules on negligence lawsuits, curbing one-way attorney fees against insurers, and shifting to a modified comparative negligence standard. According to supporters led by Governor Ron DeSantis, the reforms were necessary to address lawsuit abuse and rising insurance premiums. A Wall Street Journal editorial described the package, along with prior insurance changes, as a “tort reform dividend” that is stabilizing the market and lowering auto and homeowners rates. This positions Florida as a national model for consumer-focused legal reform.
Early results indicate that Florida’s reforms are delivering tangible savings. The Florida Office of Insurance Regulation reports that the state’s five largest auto insurers are cutting rates by an average of 6.5% for 2025 after years of steep increases. Progressive alone is refunding nearly $1 billion to Florida auto policyholders, with average rebates of roughly $300 per driver. Analysts also note that more carriers are entering the Florida market and filing for rate reductions, suggesting that the legal changes are helping tame “social inflation” and making coverage more affordable for families and businesses.
